M. Kevin Powell

M. Kevin Powell has focused his practice on the defense of corporations, insurers, and individuals in complex litigation with an emphasis on toxic torts, environmental issues, premises liability and property torts, and product liability cases. Mr. Powell also has substantial experience in mass tort and class action litigation, as well as e-discovery data retention, collection and processing.  He has represented clients in state and federal courts, both at the trial and appellate level in Louisiana and in other states.   

For over a decade Mr. Powell has acted as national coordinating counsel for a Fortune 500 company in multi-district litigation where claims of an industry-wide conspiracy to hide the health effects of vinyl chloride monomer were at issue.  He has developed and advised the client on and implemented litigation strategies for this litigation in jurisdictions throughout the United States. 

Recently, Mr. Powell successfully represented a major oil company in hundreds of personal injury, property damage, and business interruption cases arising out of the second largest on-shore oil spill in United States history.  Mr. Powell was trial co-counsel and obtained a defense verdict from a jury in a property contamination case where nearly $1 million in damages was sought. He also negotiated the very favorable settlement of several high-stakes business interruption cases. And he was a member of the trial team in the first-ever trial for civil penalties under the Oil Pollution Act amendments to the Clean Water Act, where the court awarded the U.S. less than 3% of the $247 million in penalties sought.

Mr. Powell has extensive experience advising clients about their document retention policies.  He has had primary responsibility for massive document production projects in mass tort, class action, and environmental litigation.  

Mr. Powell is active in both professional and community organizations.  He has been a member of the Defense Research Institute since 1999.  He has served on DRI’s Toxic Torts and Environmental Law (TTEL) Committee’s Program Steering Committee since 2001.  He was the TTEL Committee’s Program Chair from 2003 to 2005, and the Specialized Litigation Groups Coordinator from 2010 to 2012.  Currently Mr. Powell has responsibility for coordinating events for the TTEL Committee’s 2015 seminar.  Additionally, he has been active in the Louisiana State Bar Association, including serving as a Delegate to the LSBA House of Delegates from 2010 to 2012 and as an Assistant Bar Examiner of Louisiana Civil Procedure since 2009. 

In the community, Mr. Powell has volunteered as a Court Appointed Special Advocate (CASA) for children, was a member of the Board of Directors of Educational and Treatment Center, Inc. (an organization for troubled youth), and Served as a Program Audit Committee Member for the United Way.  In 2011, Mr. Powell graduated from Leadership Southwest Louisiana, a program designed to strengthen the leadership qualities of selected Chamber of Commerce members and community representatives.
